Terms & Conditions
1. Interpretation and Definitions:
“Company” refers to Multireach Broadband Services Private Limited. “Customer” refers to the legal entity or individual subscribing to the service. “Service” encompasses high-speed internet access, IPTV (where applicable), and value-added services. “Agreement” includes these Terms, the Customer Application Form (CAF), and the Fair Usage Policy (FUP).
2. Provision of Service and KYC Compliance:
The Company provides services subject to the submission of valid Know Your Customer (KYC) documents as mandated by the Department of Telecommunications (DoT), India. Service activation is contingent upon successful physical and document verification. The Company reserves the right to reject any application without assigning a reason.
3. Installation, Equipment, and Access:
- Access: The Customer shall provide the Company’s authorized personnel access to the premises for installation, repair, and maintenance during reasonable hours.
- Equipment Ownership: Any equipment provided by the Company (ONT, Routers, Cables) remains the sole property of the Company unless sold to the customer under a specific scheme.
- Relocation: Requests for relocation are subject to technical feasibility and relocation charges.
4. Billing, Tariffs, and Payments:
All services are provided on a pre-paid basis unless otherwise agreed in writing. Tariffs are subject to change at the Company’s discretion, following regulatory guidelines. Failure to renew the subscription before the expiry date will result in automatic suspension of services. Reconnection charges may apply.
5. Acceptable Use Policy (AUP):
The Customer agrees to use the service for lawful purposes only. Prohibited activities include:
- Reselling the bandwidth or sharing the connection outside the registered premises.
- Hosting illegal content, spamming, or engaging in hacking/cyber-terrorism.
- Infringing on intellectual property rights or distributing copyrighted material without authorization.
- Any activity that violates the Indian Telegraph Act, 1885, or the Information Technology Act, 2000.
6. Limitation of Liability and Indemnity:
The Company’s total liability for any claim arising out of the service shall not exceed the subscription amount paid by the customer for the preceding month. The Customer agrees to indemnify Multireach Broadband against all claims, legal actions, or losses arising from the Customer’s misuse of the internet connection.
7. Suspension and Termination:
The Company may suspend service without notice if the Customer is found in breach of the AUP, fails to pay dues, or if required by government authorities. Upon termination, the Customer must return all Company-owned equipment within 48 hours.
8. Force Majeure:
The Company shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities, civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.
9. Governing Law and Jurisdiction:
This agreement is governed by the laws of the Republic of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal.
